2. Date of Race:  Friday, April 24/25, 2009

 

3. Rules:  This race will be governed by the rules as defined in The International Sailing Federation (ISAF) Racing Rules of Sailing for 2009-2012 (RRS) and the Transpac rule that states: At night if two boats are converging both boats must keep clear INCLUDING the right of way boat. Below is ISAF's Ten Racing Rule Commandments:

 

1) Port keeps clear of starboard.

2) Windward keeps clear of leeward.

3) The boat astern keeps clear of the boat ahead.

4) A boat Tacking or Jibing keeps clear of one that is not.

5) Avoid collisions. Racing Rules are defensive to prevent collisions not offensive racing tactics.

6) If you gain right of way or change course, give the other boat time to keep clear.

7) The inside boat(s) at three boat lengths from the mark is entitled to room to round the mark.

8) A boat that is backing up or not racing keeps clear.

9) If you have violated a rule, notify the race committee after the race, for a time penalty.

10) It is better to give way than to spend hours in a protest room.

 

4. Eligibility: All boats and classes 18 feet and above are eligible.  PHRF, IRC, AMERICAP, ULDB-A, ULDB-B, One Design, Cruising Class boats, Multihulls, XS Racing, ORCA, Double Handed, All Women, Single Handed are Eligible. Classes smaller than 18 feet can submit a proposal of entry no later than April 21, 2009.

 

4.1  Race Category for equipment for PHRF class:  For rating purposes only – both the long and short courses are considered to be Category 3. Life rafts, MOB equipment and a 2nd anchor are recommended, but not required.

 

4.2  Safety – All Boats: US coast Guard regulations apply with additional equipment...two cell phones, one hand held radio, one GPS, strobe lights for all crew members (suggested that all crew members to wear life jackets with strobes attached after sunset in case of MOB at night). All Boats must meet Coast Guard Regulations: at http://www.uscgboating.org/safety/fedreqs/equ_refchart.htm  The communications center for the US Coast Guard (619-278-7031) and Harbor Police (619-686-6272) are now located in the same facility.  Both entities monitor Marine Channel 16.  Any vessel in need of assistance can either radio for assistance or call the above numbers (24 hours).  For assistance from SeaTow call 562-592-2808

 

4.3  Insurance -  Each participating boat shall be insured with valid combined single limit watercraft liability insurance in an amount of not less than $300,000.

4.4 DISCLAIMER OF LIABILITY - Competitors participate in this regatta entirely at their own risk. See rule 4, Decision to Race. The Organizing Authorities will not accept liability for damage or personal injury or death sustained in conjunction with, prior to, during, or after this race. Boat Owner must sign Race Entry form releasing all liability on the Race Organizers, their sponsors, contractors and anyone affiliated with the event.

 

4.5  Ratings: All boats racing are required to have a current rating for the classes and sub-classes in which they entered. For PHRF and Cruz Class - Long Course use RLC rating. Short Course use OWC rating.

 

4.6  A completed 2009 Entry must be received by no later than 1700 hours, Tuesday, April 21, 2009.

 

4.7  Any boat that has its rating changed after having submitted an Entry Form and before 1700 hours Tuesday, April 21, 2009, shall provide XS Racing with the new rating. Any boat whose rating is changed after 1700 hours Tuesday, April 21, 2009 shall sail under her original rating certificate.

 

4.8  XS racing reserves the right to move any boat to any class, which is deemed the most appropriate to the Race Committee.

 

5.  Entry Fee:

 

5.1  The entry fee before March 1 2009: 18 to 23 feet - $65. 24 to 30 feet - $95.  31 feet and above - $120.. The entry fee after March 1 2009:18 to 23 feet - $95. 24 to 30 feet - $125. 31 feet and above - $150.

 

5.2  A completed 2009 Entry must be received by no later than 1700 hours, Tuesday, April 21, 2009. Go to www.TheBorderRun.org to enter online by clicking on ‘Entry’ page and fill out the form and click submit. If an entry is canceled (WITHDRAWN) prior to April 1, 2009, 50% of the entry will be refunded. After that date, no refunds will be made.

 

6.  Notice to Competitors:  Changes to Sailing Instructions -  There will be No Skipper Packets before the race.  The NOR’s and Sailing Instructions have all information to race in The Border Run

                                    

6.1 Any changes to the NOR's, Sailing Instructions, event schedules will be posted on www.TheBorderRun.org.  Be sure to check the website on April 23, 2009 at 1700 hours for any last changes.  Or request latest NOR’s and SI’s from the RC boat at check-in before the start.

 

7.  Classes: All Classes invited. 

 

7.1 PHRF, IRC, AMERICAP, ULDB-A, ULDB-B, One Design, Cruising Class boats, Multihulls, XS Racing, ORCA, Double Handed, All Women, Single Handed are Eligible.

 

7.2  Other Classes can submit a proposal of entry no later than April 21, 2009.

 

7.3 Three entries constitute a class but do not guarantee a separate start. Final Classes and starts will be announced by 1700 April 22 2009.

 

 

8.  Starting Time and Location:

 

8.1  A 10 minute Warning Signal is scheduled at 1050 hours with the start to be at 1100 hours GPS time for the first class.  All boats must check in to the RC boat before 1050 hours.

 

8.2  The starting line will be set in the vicinity of the “J” mark, the bell buoy off the entrance of Newport Harbor. See Sailing Instructions for details and waypoints.

 

9.  Courses:  Two Courses to choose from:  Disclaimer: Waypoints are estimated.  Sailors are responsible for their own navigation and should check charts waypoints.

 

9.1 Long Course racers will start and sail to the Coronado Islands, leaving the small island (Coronado del Norte) to port and finish between a mark set just west of the Zuniga jetty (32° 40’ 00” N and 117° 13’ 23” W) and the SD channel buoy #8  (labeled R”8” Fl R 2.5s at 33° 39’ 55” N by 117° 13’ 36” W).  Center of the finish line waypoint is at approx (32° 39’ 58” N by 117° 13’ 29” W). 9.2  Short Course racers will start and sail to the SD Entrance Whistle Buoy (aprox waypoint at 32° 37’ 18” N by 117° 14’ 45” W) leaving it to port and finish between a mark set just west of the Zuniga jetty (32° 40’ 00” N by 117° 13’ 23” W) and the SD channel buoy #8  (labeled R”8” Fl R 2.5s at 33° 39’ 55” N by 117° 13’ 36” W). Center of the finish line waypoint is at approx (32° 39’ 58” N by 117° 13’ 29” W)   Handicap distance is 69 nm.   Disclaimer: Waypoints are estimated.  Sailors are responsible for their own navigation and should check charts waypoints.

 

XS Racing Beach Cat Class sailing the short course as described above must keep two marks to starboard.  First mark  FL Y 4S  (33° 20’ 15” N  and 117° 37’ 09” west)  off San Mateo Point and second mark Navy Y buoy off La Jolla (32° 53’ 53” north and 117° 31’ 31” west).  Disclaimer: Waypoints are estimated.  Sailors are responsible for their own navigation and should check charts waypoints.

 

10. Time Limit:   The time limit for all boats will be 1430 hours, Saturday, April 25th, 2009.

 

11. After Party, Trophies and cash Gift Certificates:

 

11.1   After Party, trophies and cash gift certificates will be awarded after the race on Saturday at The San Diego Yacht Club. Live band with food and drink. Trophy presentation at 1700 hours Saturday, April 25th, 2009.   Schedule of events for Saturday, April 25:

 

7:00am  - SDYC opens for breakfast. Cash accepted for breakfast by SDYC.

10:00 am  -  Border Run Photographer open for Crew and Sailing Photos

11:00 am  - Inside Bar opens inside SDYC.  Open all Day and Night!  Wahoo!

12:00 noon  - Outside No host bars opens for Border Run racers with chips and salsa.

1:00 to 4:00pm -  Mexican Fiesta Buffet opens. $11.00 per person - Tacos, Rice and Beans

1:00 to 6pm - LomaTones Band opens their first set at 1pm and will play thru 6 pm

2:30pm - Race Finish Deadline - Get to the SDYC by 2:30pm and don’t miss the party!

3:00 to 4:00pm  - Arbitration / Protests heard

5:00 to 6:00pm  -Trophy presentations begins!

6:00pm  -Time to Party at SDYC or shuttles will take you to the famous GasLamp District or Shelter Island!

 

11.2  Number of trophies based on the number of starters as follows:  2 - 5 starters = 2 trophies  6 - 9 starters = 3 trophies 10 - 15 starters = 4 trophies 16 and over  = 5 trophies. Gift Certificates from Sponsors of Race - Amounts To Be Announced.

 

12.  Seminar and Send-off Cocktail Party

 

12.1 Seminar and Send Off Cocktail Party will be in Newport Beach at the Balboa Inn / Siena Bar and Restaurant.  The Seminar starts at 5pm, the Party starts at 6pm with no host bar and hors d’œuvres. Live band starts at 6:30 to 7pm with no host food and drinks.  Seatow will offer shuttle service from Yacht Clubs and boats to the party.  See details on The Parties page at www.TheBorderRun.org

2.   Rules

2.2    Sponsorship and Advertising is allowed.

 

2.3   Boats are subject to inspection by XS Racing to ensure conformity to the applicable class rules, bylaws and/or measurement certificates.

 

2.4 Performance Handicap Racing Fleet of Southern California (PHRF) Marine Industry Racer (MIR) Rule shall not apply.

 

2.5 For boats rated with movable ballast RRS 51 is waived, but only with respect to the shifting of their declared and measured ballast.   RRS 52 is waived but only with respect to the shifting of that ballast. All ballast systems shall also be capable of manual operation.

 

2.6 Damages – XS Racing Prescribes:

 

(a) A boat that retires from a race or accepts a penalty does not, by that action alone, admit liability for damages.

 

 

 

(b) An Arbitration Committee shall find facts and make decisions only in compliance with the rules. No protest committee or US SAILING appeal authority shall adjudicate any claim for damages. Such a claim is subject to the jurisdiction of the courts.

 

(c) A basic purpose of the rules is to prevent contact between boats. By participating in an event governed by the rules, a boat agrees that responsibility for damages arising from any breach of the rules shall be based on fault as determined by application of the rules, and that she shall not be governed by the legal doctrine of 'assumption of risk' for monetary damages resulting from contact with other boats.

 

2.7 Cruising Classes are prohibited from using the engine unless the Cruising Class submits to XS to allow a Motoring Time Handicap.  Rule change will be posted no later than April 23, 2009.

4.   Changes to Sailing Instructions -  There will be No Skipper Packets before the race.  The NOR’s and Sailing Instructions have all information required to race in The Border Run

7.2    The Fleet will be divided into Classes based on Number of Boats, Class and Ratings.  Current Starting Order and Classes as of 4/22/09 are based on the speed of the boats to clear the line for the next class. 8.    Racing Area

 

8.1  Long Course - The Racing Area will be in the Pacific Ocean between Newport Beach and Coronado del Norte and San Diego.

 

8.2   Short Course - The Racing Area will be in the Pacific Ocean between Newport Beach and San Diego.

10.   Starting

 

10.1  The Starting Line will be between an orange flag on or near the Race Committee boat (on the starboard end) and a yellow mark (on the port end) and located .3 NM SE  of the “J” mark, the bell buoy off the entrance of Newport Harbor (aprox. waypoint of N33.35.06, W117.52.69)

 

10.2  Races will be started by using RRS 26. First warning will be at 1050 hours GPS / PST time . First Class start to be at 1100 hours GPS/PST time. Starts after the first start will be in 5 - minute intervals.

 

10.3  A boat whose warning signal and class flag and number has not been made shall avoid the starting area.

 

10.4  Starting Order and Classes will be posted by 1700 hours on April 23rd 2009.

 

10.5  Check-in.  Prior to the first warning signal at 1050 hours each boat shall sail by the Race Committee boat and hail her Class and Sail number until acknowledged by the committee boat. If a vessel can not hail the committee boat check in by radio using CHANNEL 72 by supplying Sail Number and Class.

 

10.6  During the start of your class monitor Channel 72 for Race Committee instructions and hails.

 

11.   Recalls and Over Early at the Start

 

11.1  Race Committee will hail boats that are over early by calling out their sail numbers on Channel 72.

 

11.2  If over early, do not return to the start line for restart.  Continue racing.  A 30 minute time penalty will be added to the elapsed time of the over early vessel.

 

11.3  General recalls will be signaled in accordance with RRS 29.2

 

12.   Finishing

 

WARNING:  The Finish line will be set just west of the end of the Zuniga jetty.  The finish boat will be a 56 foot white powerboat anchored just east of the jetty.  If you sail east of the end of the Zuniga jetty it is shallow and vessels could run aground if they proceed toward the shoreDisclaimer: Waypoints are estimated.  Sailors are responsible for their own navigation and should check charts waypoints.

 

12.1 The Finish Line for BOTH the Long and Short course will be between a mark set just west of the committee boat stationed off the Zuniga jetty (32 40 00 N and 117 13 23 West) and the SD channel buoy #8  (labeled R”8” Fl R 2.5s at 33 39 55 N by 117 13 36 W).  Center of the finish line waypoint is at aprox (32 39 58 N by 117 13 29 W).  Disclaimer: Waypoints are estimated.  Sailors are responsible for their own navigation and should check charts waypoints.

 

12.2  Boats finishing at night must contact the Race Committee boat on Channel 72 when passing the Buoy “SD” , 2.85 nm from the finish with name of vessel, sail number, class and course. Also boats finishing at night must illuminate their sail numbers for 60 seconds just prior to passing the committee boat. 

 

12.3  All boats shall take their own finishing time when crossing the line AND record the finishing boat name and sail numbers immediately ahead of them, next to them, and behind them.  Write down the time using the GPS set at Pacific Daylight Savings Time. Race timers must be set according to GPS reports of Pacific Daylight Savings Time or an equivalent PDST standard.  Record legibly on a clean sheet of paper your finish time, boat name, sail number, class and course (short or long) and save to turn to race committee if need.

 

12.4   If for any reason the finish line is obstructed as a result of large commercial ship traffic, a boat must give way to said vessel.  Once clear of the commercial vessel proceed to finish line.

 

12.5  If for any reason you can not make contact with the committee boat leave a message @ 562-644-3581 and leave a message containing ALL your finish information per instruction.

 

12.6  If the committee boat is not on station, boats must finish between the Zuniga jetty (32 40 00 N and 117 13 23 West) and the SD channel buoy #8  (labeled R”8” Fl R 2.5s at 33 39 55 N by 117 13 36 W).  Center of the finish line waypoint is at approx (32 39 58 N by 117 13 29 W). Record legibly on a clean sheet of paper your finish time, name of vessel, sail number, class and course (long or short) and phone in information leaving a message at 562-644-.  Once at the SDYC please turn in finish time to Border Run Committee

 

13.   Time Limit

 

13.1 The time limit for all boats will be 1430 hours, Saturday, April 25th, 2009. Any boat not finishing before the Time Limit will be scored DNF.

 

14.   Penalty System

 

14.1  Time Penalties will be given by the Arbitrary committee.

 

 

15.   Protests and Request for Redress

 

Note: The Border Run organizers would prefer to party with the racers than to hear protests after a tough overnight international yacht race. The starting line is roomy, the ocean is big and the race is long.  Avoid collisions and obey the sailing rules.   If there is a collision, take down the sail number of the colliding boat or boats, and when you hit dry land, exchange phone numbers and let the insurance companies handle it.  The Border Run organizers want this event to be a competitive, fun race…not a disgruntled, argumentative trial. Summary: Race hard, sail fair, and leave it on the water. Stay clear of protest situations.  If you can't, read below for the process:

 

 15.1 If you decide to protest, competitors will first be subject to arbitration, but be prepared to miss the party and put up a $300 arbitration deposit that will be donated to the Leukemia Cup. Your choice!

 

15.2 Arbitration will commence no later than 3 pm, Saturday, at SDYC.  It is the responsibility of each boat to check the Official notice board at the Border Run event at the SDYC and be properly prepared to attend the hearing in a timely manner.

 

15.3  Arbitration: an Arbitration hearing will be held and are lodged pursuant to the sailing instructions. One representative from each boat will testify before an Arbitrator. No witnesses shall be allowed.

 

15.4  After the testimony of each representative, the Arbitrator shall reach one of the following conclusions:

 

A) There was no breach of a rule. the protest is withdrawn and cannot be reopened.

 

B  There was a breach of a rule by one or more of the boats involved. The penalty will be either of the option of accepting a 40% alternative penalty (calculated as in Rule 44.3 (c)) or alternate time penalty to be determined by the Arbitrator.  If the penalty is accepted, the matter cannot be reopened or made the subject of a redress request.

 

15.5  Redress - The Race Committee will consider an appropriate time allowance for time lost while aiding a vessel in distress. When stopping to aid another boat or crew from another boat, note the time when your forward progress has ended. When you begin to progress towards the next mark, note the time for possible redress. Motoring is permitted in the aid of a distressed boat or crew. Redress for altercations with other racing yachts will only be awarded in extreme cases.

 

16.   Scoring

 

16.1  Scoring will be according to RRS A 4.1 Low Point System

 

17.   Retirements

 

17.1  A yacht that retires from a race shall attempt to notify the Committee on VHF Channel 72 as soon as possible.

 

17.2  If that is not possible, notify XS Racing as soon as possible by calling Hans Witten at 562-644-3581. Provide a contact name / number, boat name, your sail number, class, course (long or short) and your status.

 

18.   Official Boats - Official boats will be marked using Race Committee Flags marked as the Border Run

 

19.   Radio Communication

 

19.1  A competitor shall neither make radio transmissions while racing nor receive radio transmissions not available to all boats. This restriction also applies to mobile telephones. Before and after the race the committee boat and SeaTow chase boats will monitor CHANNEL 72 for non emergency communication. For Emergency use CHANNEL 16.  The communications center for the US Coast Guard (619-278-7031) and Harbor Police (619-686-6272) are now located in the same facility.  Both entities monitor Marine Channel 16.  Any vessel in need of assistance can either radio for assistance or call the above numbers (24 hours).  For assistance from SeaTow call 562-592-2808

 

20.   Trophies and Prizes - Trophies will be awarded at San Diego Yacht Club at 1700 hours.

Trophies and cash gift certificates for this race will be awarded after the race in each class based on the number of starters as follows:  2 - 5 starters = 2 trophies  6 - 9 starters = 3 trophies 10 - 15 starters = 4 trophies 16 and over  = 5 trophies. 21.   Disclaimer of Liability - Competitors participate in the regatta entirely at their own risk. See RRS 4, Decision to Race. The organizing authority will not accept any liability for material damage or personal injury or death sustained in conjunction with or prior to, during, or after the regatta.

 

22.  Insurance Requirements - Each participating boat shall be insured with valid third-party liability insurance with a minimum cover of $300,000.00 per event or equivalent.
